IKÉMEN COLLECTION: Blooming Garden Terms of Use

These Terms and Conditions set forth the terms of use for the NFT, including the rights granted to persons holding IKÉMEN COLLECTION: Blooming Garden (hereinafter referred to as the "the NFT") which are NFT arts issued by CYBIRD Co., Ltd. (hereinafter referred to as the "We") (hereinafter referred to as the "NFT Holder"). If you wish to receive a transfer of the NFT, please read these Terms and Conditions in advance.

Article 1 (General Provisions)
1. Customers wishing to accept the transfer of the NFT shall understand and agree to the terms and conditions set forth in this Agreement in advance. Upon completion of the transfer of the NFT, the Customer shall be deemed to have agreed to this Agreement.
2. In the event the Customer purchases the NFT directly from us, the terms and conditions for such transactions shall be governed by "Terms and Conditions for NFT Sales Services" separately set forth by us.

Article 2 (Rights of NFT Holders)
1.We shall grant NFT Holder the exclusive worldwide right to use the NFT (whether for private or commercial use). Provided, however, that such use shall be limited to without adaptation.
2.NFT Holder may not be used in the manner set forth below. NFT Holder shall lose the right to use the NFT if such use is permitted in the manner set forth below.
(1) Use beyond the scope of rights granted in this Agreement
(2) Use for purposes related to sex industry or other sexual services
(3) Use for the Purpose of Violence, Indecency or Discrimination
(4) Use for the purpose of facilitating anti-social forces
(5) Use in connection with criminal acts or use contrary to public policy
(6) Use for a purpose that is likely to cause damage to We, other users, or any other third party
(7) Use that is reasonably determined by us to be inappropriate
3.The license provided for in Paragraph 1 shall not prevent us from producing a new work using the elements (characters, etc.) of the work that are tied to the NFT and from publishing NFT arts that differ from those of the NFT using such work.
4.NFT Holder will acquire the right to use the NFT to the extent set forth in this Agreement, but no copyright, trademark right, or other intellectual property right will be transferred.

Article 3 (Non-Warranty)
In the event NFT Holder or any subsequent acquirer or any other third party suffers any damage in connection with the purchase or sale of us shall have no legal liability whatsoever for the cause of such damage.
